V2 Fragrance & Cosmetics S.R.L. with registered and operational office in Via Francesco Bellafino 29, 24126 Bergamo (BG), tax code and VAT number IT04880580164, registration number in the Register of Companies of Bergamo, PEC: pec@pec.v2fragrancecosmetics.it, Unique Code (SDI): M5UXCR1 (hereinafter, also "V2 Fragrance" or "SÈNTAIR" or the "Controller"), as the data controller of the personal data of users (hereinafter, "Users") who browse and use the services available on the website www.sentair.it (hereinafter, the "Website" and the "Services") provides the following privacy policy pursuant to Art. 13 of EU Regulation 2016/679 of 27 April 2016 (hereinafter, "Regulation", or also the "Applicable Legislation").

This Website and the Services are reserved for individuals aged eighteen or over. The Controller therefore does not collect personal data relating to individuals under 18 years of age. Upon User request, the Controller will promptly delete all personal data involuntarily collected relating to individuals under 18 years of age.

The Controller places the utmost importance on the right to privacy and the protection of its Users' personal data. For any information regarding this privacy policy, Users can contact the Controller at any time, using the following methods:

V2 Fragrance & Cosmetics S.R.L. has not appointed a Data Protection Officer (DPO), as it is not subject to the obligation of designation provided for in Article 37 of the Regulation.

1. Purposes of processing

Users' personal data will be lawfully processed by the Controller pursuant to Art. 6 of the Regulation for the following processing purposes:

a) Contractual obligations and provision of Services, to allow browsing of the Website or to execute the Website's Terms of Use, which are accepted by the User during registration on the Website and/or when using the Services, and to fulfill specific User requests. The User data collected by the Controller for the aforementioned purposes include: name, surname, email address, shipping and billing address, phone number, payment data, order history.

Unless the User gives the Controller specific and optional consent to the processing of their data for further purposes, the User's personal data will be used by the Controller for the sole purpose of:

  • Processing purchase orders
  • Managing product shipments
  • Providing customer support
  • Managing returns and refunds
  • Preventing possible fraud or abuse
  • Contacting the User for service reasons only (e.g., order confirmations, shipping updates)

Notwithstanding what is provided elsewhere in this privacy policy, under no circumstances will the Controller make Users' personal data accessible to other Users and/or third parties.

b) Administrative-accounting purposes, i.e., to carry out activities of an organizational, administrative, financial, and accounting nature, such as internal organizational activities and activities functional to the fulfillment of contractual and pre-contractual obligations.

c) Legal obligations, i.e., to fulfill obligations provided for by law, by an authority, by a regulation, or by European legislation.

The provision of personal data for the processing purposes indicated above is optional but necessary, as failure to provide it will make it impossible for the User to make purchases on the Website and use the Services.

Personal data necessary for the pursuit of the processing purposes described in this paragraph 1 are marked with an asterisk within the Website forms.

2. Additional processing purposes: marketing

With the free and optional consent of the User, some of the User's personal data (i.e., name, surname, email address, phone number) may also be processed by the Controller for marketing purposes (sending advertising material, direct sales, and commercial communications), so that the Controller can contact the User via email, phone, and/or SMS to propose to the User:

  • Launch of new limited edition fragrances
  • Early access to pre-orders
  • Exclusive SÈNTAIR offers and promotions
  • Invitations to exclusive events

In the event of non-consent, the ability to purchase on the Website will not be affected in any way.

In the event of consent, the User may revoke it at any time by requesting it from the Controller using the methods indicated in paragraph 7 below.

The User can also easily object to further promotional communications via email by clicking on the appropriate link to revoke consent, which is present in each promotional email. Once consent has been revoked, the Controller will send the User an email to confirm the successful revocation of consent.

The Controller informs that, following the exercise of the right to object to the sending of promotional communications via email, it is possible that, for technical and operational reasons, the User may continue to receive some additional promotional messages. Should the User continue to receive promotional messages after 24 hours have passed since exercising the right to object, please report the problem to the Controller, using the contacts indicated in paragraph 7.

3. Additional processing purposes: newsletter

With the free and optional consent of the User, some of the User's personal data (i.e., name, surname, email address) may also be processed by the Controller for the purpose of sending the newsletter. Therefore, the User will receive a periodic newsletter from the Controller containing information regarding:

  • News from the SÈNTAIR collection
  • Updates on pre-orders and limited edition launches
  • Invitations to exclusive events
  • Editorial content about the world of ambient fragrances

In the event of non-consent, the ability to purchase on the Website will not be affected in any way.

In the event of consent, the User may revoke it at any time by requesting it from the Controller using the methods indicated in paragraph 7 below.

The User can also easily object to further newsletter mailings by clicking on the appropriate link to revoke consent, which is present in each email containing the newsletter. Once consent has been revoked, the Controller will send the User an email to confirm the successful revocation of consent.

4. Methods of processing and data retention periods

The Controller will process Users' personal data using manual and electronic tools, with logic strictly related to the purposes themselves and, in any case, in such a way as to guarantee the security and confidentiality of the data.

Users' personal data will be stored for the time strictly necessary to fulfill the primary purposes illustrated in the previous paragraph 1, or in any case as necessary for the civil law protection of the interests of both Users and the Data Controller.

In the cases referred to in the previous paragraphs 2 and 3, Users' personal data will be stored for the time strictly necessary to fulfill the purposes illustrated therein and, in any case, for no more than twenty-four (24) months from the withdrawal of consent or the termination of the contractual relationship.

5. Scope of data communication and dissemination

Some of the User's data may be transferred to countries other than Italy, including other countries within the European Union. The Data Controller will ensure that the transfer takes place in accordance with the Applicable Regulations and, in particular, in accordance with Articles 45 (Transfers on the basis of an adequacy decision) and 46 (Transfers subject to appropriate safeguards) of the Regulation.

Employees and/or collaborators of the Data Controller responsible for managing the Site and all services related to the provision of the Services may become aware of Users' personal data. These individuals, who have been instructed to do so by the Data Controller pursuant to Article 29 of the Regulation, will process Users' data exclusively for the purposes indicated in this information notice and in compliance with the provisions of the Applicable Regulations.

Third parties who may process personal data on behalf of the Data Controller as "External Data Processors", such as:

  • IT and hosting service providers
  • E-commerce platform operators (Shopify)
  • Logistics and shipping service providers
  • Payment service providers
  • Email marketing service providers
  • Professionals and consultants

Users have the right to obtain a list of any data processors appointed by the Data Controller, by submitting a request using the methods indicated in paragraph 7 below.

Furthermore, Users' personal data may be communicated by the Data Controller, to the extent that this is necessary and essential to fulfill contractual obligations, to independent third-party data controllers, such as payment service providers (e.g., Shopify Payments, PayPal) and logistics service providers necessary for the delivery of products sold through the Site. These independent controllers will process User data exclusively for the purpose of correctly fulfilling orders.

7. Rights of Data Subjects

Users may exercise their rights guaranteed by the Applicable Regulations by contacting the Data Controller using the following methods:

Pursuant to the Applicable Regulations, the Data Controller informs that Users have the right to obtain indications (i) of the origin of personal data; (ii) of the purposes and methods of processing; (iii) of the logic applied in case of processing carried out with the aid of electronic instruments; (iv) of the identification details of the Data Controller and data processors; (v) of the subjects or categories of subjects to whom personal data may be communicated or who may become aware of them as data processors or persons in charge of processing.

Furthermore, Users have the right to obtain:

a) access, updating, rectification, or, where interested, integration of the data;

b) erasure, anonymization, or blocking of data processed in violation of the law, including data whose retention is not necessary for the purposes for which the data were collected or subsequently processed;

c) certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in cases where such fulfillment proves impossible or involves a manifestly disproportionate use of means compared to the protected right.

Furthermore, Users have:

a) the right to withdraw consent at any time, if the processing is based on their consent;

b) (where applicable) the right to data portability (right to receive all personal data concerning them in a structured, commonly used and machine-readable format), the right to restrict the processing of personal data and the right to erasure ("right to be forgotten");

c) the right to object:
i) in whole or in part, on legitimate grounds, to the processing of personal data concerning them, even if pertinent to the purpose of the collection;
ii) in whole or in part, to the processing of personal data concerning them for the purpose of sending advertising material or direct selling or for carrying out market research or commercial communication;
iii) where personal data are processed for direct marketing purposes, at any time, to the processing of their data carried out for such purpose;

d) if they believe that the processing concerning them violates the Regulation, the right to lodge a complaint with a Supervisory Authority (in the Member State of their habitual residence, their place of work, or the place of the alleged infringement). The Data Controller is not responsible for updating all the links displayed in this Privacy Policy, therefore whenever a link is not functional and/or updated, Users acknowledge and accept that they must always refer to the document and/or section of the websites referred to by such link.
